Contentpass Terms and Conditions

This is a convenience translation. The German version of these Terms and Conditions is the sole legally binding version.

Thank you for choosing Contentpass. We developed Contentpass because we care equally about privacy, a healthy media landscape and an uncomplicated reading experience — so you can read online publications without seeing adverts and without being tracked. Our offerings give you access to content from multiple publishers, simply with a single login and without having to register separately with each publisher.

Below we present our Terms and Conditions, which describe our service and your rights in more detail.

1. Scope of the T&Cs

Contentpass is a service of Content Pass GmbH, Wolfswerder 58, 14532 Kleinmachnow, Germany (hereinafter "Contentpass", "we", "us", "our"), (Amtsgericht Potsdam HRB 29401 P). We perform the contract with you exclusively in accordance with these T&Cs. For information on how we process your personal data, please refer to our privacy policy.

These T&Cs apply from the creation of your Contentpass account, regardless of whether you use additional services such as the advertising- and tracking-free offering.

1.1. Contentpass is intended for consumers within the meaning of Section 13 of the German Civil Code (BGB). Where services are provided to businesses or public institutions, the consumer-protection provisions of these T&Cs do not apply. This will be indicated separately.

A prerequisite for businesses or public institutions to enter into a contract with Contentpass is that the user has their registered business address in the EU.

1.2. Contentpass advertising- and tracking-free online publications

The following Terms and Conditions ("T&Cs") apply to our fee-based Contentpass (advertising- and tracking-free visiting of websites; for more details see 2.2. and 2.3.). Excluded from this are services of so-called third-party services, which are marked as such accordingly and are not offered by us but by a third party.

1.3. Regio Pass offerings

We work with various media companies. If you are a subscriber of one of our partners listed here, you can register via Contentpass to access the content of all partners. The contract for the use of our partners' content is concluded with us.

To use a Contentpass account, you enter into a separate contract with us. Through this account you can then use the partners' offerings. We provide the registration platform for your use of the content under this contract.

2. Our services

2.1. You can visit media offerings and apps via your Contentpass access free of advertising and tracking, or unlock content from our Regio Pass partners.

2.2. Advertising- and tracking-free visiting of websites

We enable you to visit the participating digital offerings such as websites and apps (of our contractual partners, hereinafter referred to as "Publishers") free of advertising and tracking. In this context, advertising- and tracking-free means that when you use our service while visiting a Publisher's offering, no third-party components or services are used that aim to store and use your personal data or behaviour. You pay us and we pay the Publishers from our revenue. You are recognised as a user of our service by the Publisher and can visit their offerings without advertising or tracking.

Such components or services are typically cookies, advertising trackers or plugins that regularly, but not exclusively, require your consent. These components and services could, for example, create user profiles about you, even across a large number of websites.

By using our service, the use of such components and services is prevented, so that you are generally not visible to third parties when visiting participating websites.

2.3. Exclusion of Publisher components

Please note that advertising and tracking components for the Publisher's own offerings or other services of the Publisher are not technically prevented by our service. Among other things, advertising for the Publisher's own products and the analysis of website usage for statistical purposes or to improve the offering by the website operator will still be possible. You may find more information on this in the privacy policy of the respective Publisher, where applicable.

2.4. Regio Pass service

The Regio Pass provides access to content from multiple partner publishers — including content behind paywalls.

With your home publisher, you continue to use your usual access. With all other participating publishers, content is unlocked via your Contentpass account — one shared login for all.

You can register on our website at any time with a Contentpass account (see Section 4) and decide which services you wish to use.

2.5. Availability of our service

We maintain our service up to 99.5% operational on an annual average. We warrant that we will use reasonable endeavours to ensure that you receive the advertising and tracking freedom booked with our service to the extent we specify. Scheduled maintenance periods, which will be announced in a timely and reasonable manner, are excluded.

We are not responsible for the functionality of the participating Publisher's site. We do not guarantee the functionality and availability of the respective Publisher's website. Please contact the respective Publisher regarding such disruptions.

3. Use of the Contentpass account

3.1. Creating a Contentpass account

3.1.1. To use our services, you need a Contentpass account. You can either create this directly via the Contentpass website or you will be directed to us from a participating website. To create an account we only require

  • your email address,
  • a password for your account, and
  • for tax reasons, the country of your permanent residence.

3.1.2. Your email address is also used to verify your registration by sending you an email to confirm the creation of your account, in which we will ask you to confirm by means of a code. Once you have confirmed your registration, your account will be created immediately and you will receive a confirmation from us. Immediately after confirmation of the creation of your Contentpass account, you can log in to your account, automatically visit the participating website free of advertising and tracking, or use the Regio Pass.

3.1.3. We reserve the right to delete multiple registrations.

3.2. Function and management of the Contentpass account

In your Contentpass account you can manage your subscriptions booked with us. This means you can terminate your subscription directly via your account.

At the same time, you can change, enter and manage your email address and password as well as optionally other personal data in your account. If you wish to receive an invoice, you can also specify this option in your account and download the invoice from your account. For the option of invoicing by us, please see Section 7 (Invoice).

You are obliged to keep your login credentials, in particular your password, confidential. A Contentpass account can be used simultaneously on up to 5 devices. In the event of misuse, we reserve the right to block access. The use of the account (so-called account sharing) by third parties is not permitted. You are obliged to report any unauthorised use of your Contentpass account as well as any other breach of security provisions to us without delay.

4. Registration, use and termination of the Regio Pass

There are two prerequisites for using the Regio Pass:

  • An active subscription with a partner publisher ("home subscription")
  • A free Contentpass account

To verify your subscription status with the respective partner publisher, registration must be started on the website of the respective home publisher. The exact procedure and the links to the respective registration pages can be found here.

If you already have a Contentpass account, you can use it.

The Regio Pass is linked to your subscription status with the home publisher.

Important: If you cancel your home subscription, your use of the Regio Pass with all participating publishers will end. Your Contentpass account will remain active and can continue to be used for other cross-publisher offerings.

5. Deletion of the Contentpass account

You can delete your account with us independently at any time on your account page. The prerequisite for deletion is that you do not have a current subscription with us at the time of the intended deletion, or that the term of your most recently concluded subscription has expired.

6. Remuneration, payment, payment method

6.1. Remuneration

You pay a monthly subscription fee for the use of our service, which depends on how many digital offerings participate in Contentpass.

6.2. Payment

The remuneration is payable monthly in advance and will not be refunded, even partially, if you do not wish to use the service.

You may use our fee-based Contentpass by (1) paying a monthly subscription fee in advance, or (2) by making an advance payment that gives you access to our fee-based service for a specified period of time.

6.3. Payment method

Contentpass users can choose between the various payment methods available, which you can find here.

7. Invoice

If you need an invoice from us, you can activate this option in your account (see 3.2. Function and management of the Contentpass account). For invoicing, we need your postal address, which you can store in your Contentpass account.

You can download the invoice conveniently and free of charge in your Contentpass account.

8. Term, termination, right of withdrawal

8.1. Term and termination

The contract for Contentpass advertising- and tracking-free online publications is concluded upon creation of the account. Reference is made to Section 1 (Scope). The contract period is one month at a time and the contract is automatically extended by a further month if it is not terminated by you via your account or in text form (e.g. by email), or by us two days before the end of the month in text form (e.g. by email). We may terminate the contract for good cause or block your access to our Contentpass for good cause. Your right to terminate for good cause remains unaffected.

8.2. Special right of termination

If you do not agree with the application of the adapted or amended Terms and Conditions, you have a special right of termination. You are entitled to terminate the contract upon the amended terms taking effect.

8.3. Right of withdrawal

If you are a consumer within the meaning of Section 13 of the German Civil Code (BGB), you have the following right to withdraw from the booking of a fee-based subscription.

You have the right to withdraw from a booked subscription within 14 days and without giving any reason. The withdrawal period is 14 days from the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Content Pass GmbH, Wolfswerder 58, 14532 Kleinmachnow, Germany, support@contentpass.de) by means of a clear statement (e.g. preferably by email, or by post) of your withdrawal.

You may use the sample form provided by us for this purpose, but this is not mandatory.

9. Restrictions and changes to the service

Due to technical progress and ever-changing circumstances, it may be necessary to carry out maintenance work, tests and updates on our Contentpass services. Despite our best efforts, technical difficulties in the provision of our services can never be completely ruled out. Due to the aforementioned circumstances, temporary disruptions to our services may nevertheless occur from time to time. Scheduled maintenance periods and the associated temporary disruptions are not subject to the availability stated in Section 2.5 (Availability of our service).

We will nevertheless always endeavour to provide our service to your fullest satisfaction. We will use reasonable efforts and measures to keep our services operational.

10. Limitations of liability

We are liable exclusively for intent and gross negligence, as well as for the breach of cardinal obligations or due to injury to life, body or health by us, our vicarious agents or our auxiliary agents. Insofar as we are liable for the breach of cardinal obligations, the claim for compensation for financial loss and damage to property is limited to the typically foreseeable damage.

This limitation of liability applies accordingly to claims in tort.

Liability under the Product Liability Act remains unaffected. "Cardinal obligations" are those obligations that are necessary for the proper performance of this contract in the first place and on whose compliance the user regularly relies and may regularly rely.

11. Choice of law

All disputes arising in connection with the use of Contentpass or with the use of the Contentpass account shall be governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
